Scale Wizard – Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of the Scale Wizard mobile application (the “App”), operated by Wizard Apps Ltd (“we”, “us”, “our”).
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, you must not use the App.
1. About the App
Scale Wizard is music-related software that provides tools and configurable exercises to support practice and learning. The App does not provide formal tuition, certification, or guaranteed outcomes.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under 18, you must have permission from a parent or legal guardian.
3. Licence to use the App
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, subject to these Terms and the Apple End User Licence Agreement (EULA).
You must not:
- Copy, modify, distribute, sell, or lease any part of the App.
- Reverse engineer, decompile, or attempt to extract the source code (except to the extent permitted by law).
- Use the App for unlawful, harmful, or abusive purposes.
4. Monthly subscription, billing, and cancellation
The App offers paid features via a monthly auto-renewing subscription purchased through Apple In-App Purchases. Prices are shown in the App before you confirm purchase.
- Billing: payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- Renewal charges: your account will be charged for renewal within 24 hours prior to the end of the current period.
- Manage/cancel: you can manage and cancel subscriptions in your Apple ID account settings.
We do not control Apple’s billing processes. Refund requests are handled by Apple in accordance with Apple’s policies.
5. Free trials (if offered)
If we offer a free trial, it will convert to a paid subscription unless cancelled before the trial ends. Any unused portion of a free trial may be forfeited when you purchase a subscription, as permitted by Apple’s rules.
6. User responsibility and disclaimers
The App is provided for general practice and educational support only. You are responsible for how you interpret and apply the App’s outputs. Results depend on individual effort, practice, and context. We do not guarantee accuracy, progress, or outcomes.
The App does not provide medical or physical advice. If you experience pain or discomfort while practising an instrument, stop and seek appropriate professional guidance.
7. Third-party content and links
The App may link to third-party content or services (for example, YouTube). We do not control third-party content and are not responsible for its availability, accuracy, or policies. Your use of third-party services is subject to their own terms and privacy policies.
8. Intellectual property
All rights, title, and interest in and to the App (including software, design, text, exercises, and branding) are owned by Wizard Apps Ltd or its licensors. You may not use our intellectual property without prior written consent, except as allowed under these Terms.
9. Feedback
If you submit feedback, suggestions, or ideas, you agree we may use them without restriction and without compensation. (Beta feedback remains governed by the separate Beta Feedback Terms.)
10. Availability, updates, and changes
We may update, modify, suspend, or discontinue the App (or any part of it) at any time. We do not guarantee uninterrupted availability.
11. Termination
We may suspend or terminate your access to the App if you breach these Terms, if required by law, or if necessary to protect users or the App.
12. Limitation of liability
To the fullest extent permitted by law, the App is provided “as is” and we exclude liability for indirect or consequential losses. Our total liability to you for claims arising out of or in connection with the App will not exceed the amount you paid (if any) for the App in the 12 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
13. Privacy
Your use of the App is also governed by our Privacy Policy.
14. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to these Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
